GetMine Terms of Service

1. Who can use GetMine

You must be at least 18 years old, live in the United States, and be able to enter into a binding contract. You may have only one account, and the information you give us must be accurate.

2. What GetMine does

GetMine helps you find class action settlements and refund programs you may qualify for, keep the information claim forms ask for in one place, fill in official claim forms, track your claims, and remember deadlines.

3. What GetMine is not

GetMine is not a law firm and does not give legal, tax, or financial advice. Using GetMine does not create an attorney-client relationship. We are not affiliated with, endorsed by, or acting for any court, settlement administrator, class counsel, or company involved in a settlement. Settlement information comes from public sources and may be incomplete, out of date, or wrong. Always check the official settlement website before you file.

4. You file your own claims

We never submit claims for you. You decide whether to file, review every claim form, and submit it yourself on the official settlement website or by mail. Filing a claim through an official settlement website is always free; you never need to pay us to take part in a settlement. You are responsible for everything you submit.

5. Only file truthful claims

Claim forms are usually signed under penalty of perjury. Only file claims for settlements whose class definition you actually meet, only for yourself (or someone you are legally authorized to act for), and only as many times as the settlement allows. Do not use GetMine to file false, duplicate, bulk, or automated claims. We may suspend or close accounts we believe are used for false claims, and we may share information about them as described in our Privacy Policy.

6. No guarantee of eligibility or payment

Matches and payout estimates are based on public information and your answers. They are not promises. The settlement administrator decides whether your claim is valid and how much is paid. Payments can be reduced, delayed, or denied, and settlements can change, be appealed, or be cancelled. Some settlement payments may be taxable.

7. Smart Autofill and other websites

Smart Autofill opens the official settlement website inside GetMine and fills in fields with information you have saved. You must check every field before you submit. Websites run by settlement administrators and others are not controlled by us, and their own terms and privacy policies apply. We are not responsible for their content, their availability, or what they do with information you submit.

8. GetMine Pro subscriptions

GetMine is free to download and use with limited features. GetMine Pro is an optional paid subscription that unlocks more features, such as all of your matches, Smart Autofill, claim packets, and deadline reminders.

• GetMine Pro is billed through your Apple App Store or Google Play account. The price and billing period are shown before you buy.
• Your subscription renews automatically at the end of each period unless you cancel at least 24 hours before the period ends. Your account is charged for the renewal within 24 hours before the current period ends.
• If a free trial is offered, it becomes a paid subscription when the trial ends unless you cancel at least 24 hours before it ends.
• You can manage or cancel your subscription in your App Store or Google Play account settings. Deleting the app or your GetMine account does not cancel your subscription.
• Payments and refunds are handled by Apple or Google under their policies. Except where the law or those policies require otherwise, payments are non-refundable.
• We may change prices or features. Price changes for an existing subscription follow Apple’s or Google’s rules, including any notice or consent they require.

9. Your account

Keep your sign-in methods secure; you are responsible for activity on your account. You can delete your account at any time in the app (Profile → Delete account). We may suspend or close your account if you break these Terms or if we must for legal reasons.

10. Your information and documents

You own the information and documents you add to GetMine. You give us permission to store, process, and display them only to operate GetMine for you, as described in our Privacy Policy. Only add information and documents you have the right to share. Do not upload Social Security numbers, full financial account numbers, passwords, or health or medical information.

11. Rules for using GetMine

You agree not to:

• break any law or help anyone else do so;
• impersonate anyone, or file claims for other people without their authorization;
• copy, scrape, resell, or commercially use GetMine or its settlement information;
• use bots or other automated means to access GetMine;
• reverse engineer, hack, overload, or disrupt GetMine, or upload malicious code; or
• use GetMine to harm anyone.

12. Our app and content

GetMine, including its design, software, settlement summaries, and the GetMine name and logo, belongs to Espyeon or its licensors. We give you a personal, non-transferable, revocable license to use GetMine on devices you own or control, for your own non-commercial use, under these Terms and the rules of the app store you got it from. If you send us feedback, we may use it without any obligation to you.

13. Apple and Google

These Terms are between you and Espyeon, not Apple or Google. Apple and Google are not responsible for GetMine or its content and have no obligation to provide maintenance or support for it.

If you downloaded GetMine from the Apple App Store: Apple is not responsible for any product, warranty, or intellectual property claims relating to GetMine, except that if GetMine fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); to the fullest extent the law allows, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.

14. Disclaimers

GetMine is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that GetMine will be uninterrupted or error-free, or that settlement information will be complete or current.

15. Limits on our liability

To the fullest extent the law allows, Espyeon will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or a missed, reduced, or denied settlement payment, even if we were told they were possible. Our total liability for any claim relating to GetMine is limited to the greater of the amount you paid for GetMine in the 12 months before the claim or $50. Some places do not allow these limits, so they may not apply to you.

16. Indemnity

If you break these Terms or the law, or file a false claim, and someone brings a claim against us because of it, you agree to cover our reasonable costs, including legal fees, to the extent the law allows.

17. Disputes

If you have a problem with GetMine, email contact@espyeon.com first so we can try to fix it. If we cannot resolve it within 30 days, either of us may bring a claim in small claims court or in the state or federal courts of the state in which Espyeon LLC is organized. These Terms are governed by the laws of that state, without regard to its conflict-of-law rules.

18. Changes to these Terms

We may update these Terms. We will change the date at the top and, for significant changes, tell you in the app or by email before they take effect. If you keep using GetMine after the changes take effect, you accept them.

19. Ending these Terms

You can stop using GetMine and delete your account at any time. Sections that by their nature should continue after these Terms end (such as disclaimers, limits on liability, indemnity, and disputes) will continue.

20. General

These Terms and our Privacy Policy are the entire agreement between you and us about GetMine. If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a part right away, we have not waived it. You may not transfer these Terms; we may transfer them as part of a merger, acquisition, or sale of assets.
