Kids Learn to Earn restricts other apps on a child’s device. It is a parental tool, not a substitute for supervision, and it does not guarantee any academic result. It is designed never to restrict phone calls or emergency calling — after setup, and after every system update, check that your child’s device can still place a call.
Please read these Terms before setting up Kids Learn to Earn. They are an agreement with the parent or guardian who holds the account — not with a child. Kids Learn to Earn changes how a child’s device behaves, so these Terms explain what it does and does not guarantee: it is designed never to restrict phone calls or emergency calling but cannot guarantee a device’s behaviour after an operating-system update (section 6); it does not promise better grades (section 12); and you are responsible for your parental passcode (section 9). They also limit our liability and require most disputes to be resolved by individual arbitration rather than in court.
1. Acceptance, and who may hold an account
These Terms & Conditions (the “Terms”) are a binding agreement between you and Espyeon LLC (“Espyeon”, “we”, “us”) governing the Kids Learn to Earn application and related services (the “App”).
Only a parent or legal guardian aged 18 or older may create an account, and by doing so you accept these Terms on your own behalf and on behalf of each child you add. In these Terms, “you” means the account holder, and “your child” means a child for whom you have created a profile.
Children may use the App only through a profile their parent or guardian has created, and only under that adult’s supervision and responsibility. A child cannot enter into these Terms.
These Terms incorporate the Kids Learn to Earn Privacy Policy and the Espyeon Acceptable Use Policy. Where these Terms conflict with our general Terms of Service on anything specific to Kids Learn to Earn, these Terms control.
2. What Kids Learn to Earn is, and what it is not
Kids Learn to Earn is a parental-control and educational tool. A parent chooses apps to restrict on a child’s device; the child answers grade-appropriate quiz questions; passing the parent’s pass mark unlocks the restricted apps for a limited time; when the time runs out, the restrictions return.
It is not, and must not be relied on as:
- a substitute for a parent’s supervision of their child;
- a way to keep a child safe from content, people or dangers online;
- a school, tutor, accredited curriculum or educational assessment;
- a safety, monitoring or location service — it does not track where a child is and does not alert anyone to anything; or
- a means of summoning help in an emergency.
Kids Learn to Earn is designed for children and is intended for the App Store’s Kids Category. Settings, the parent dashboard, purchases and any link that leaves the App sit behind a parental gate that a young child cannot pass.
3. Your responsibilities as a parent
You are responsible for:
- deciding whether Kids Learn to Earn is suitable for your child;
- choosing settings — the apps restricted, the pass mark, the reward window — that are appropriate for your child’s age, needs and wellbeing;
- making sure your child can still reach anything they need, including any app required for school, health, accessibility or communication with you;
- supervising your child’s use of the device and of the App; and
- everything that happens through your account and your child’s profiles.
If your child relies on an app for a medical or accessibility need — for example a glucose monitor, a hearing or communication aid, or a medication reminder — do not restrict it.
5. How device controls work, and what you authorise
Kids Learn to Earn works through controls the device’s operating system provides. By setting it up, you authorise it to use them on your child’s device:
- On iPhone and iPad, through Apple’s Screen Time API (Family Controls, Managed Settings and Device Activity), which a parent or guardian in your Apple Family Sharing group must authorise on the child’s device. Once authorised, Apple’s system may require the guardian’s approval to remove the App.
- On Android, through the system permissions the App asks for during setup, each with a clear explanation and your explicit consent. While the restrictions are active, the App shows a persistent notification.
The controls are always visible: the App has a normal icon, and a child who opens a restricted app sees the Shield explaining that a rule is in effect. How the App uses these controls, and what it can and cannot see, is set out in section 8 of the Privacy Policy.
6. Phone calls, emergency calling and essential functions
Kids Learn to Earn is engineered not to restrict the phone dialer, emergency calling (such as 911 and Emergency SOS), or core system functions. Emergency calling is provided by the device’s operating system and is designed by Apple and Google to work independently of apps like ours.
However, those operating systems are controlled by Apple and Google, not by us, and they change. We cannot guarantee how a device will behave after an operating-system update, a change to a platform’s parental-control frameworks, a device fault, a carrier limitation, or a configuration we did not anticipate.
After setting up Kids Learn to Earn, and after every operating-system update, check that your child’s device can still place a phone call. Never rely on a single device as a child’s only way to reach help. If anything prevents a call, remove the restrictions immediately using the parental override and contact us at Contact@espyeon.com.
to the maximum extent permitted by applicable law, Espyeon LLC is not liable for any inability to place or receive a call, reach emergency services, or use any device function, where that results from the behaviour of an operating system, a third-party update, a device or network fault, or a setting chosen by the account holder.
7. Device performance, compatibility and data loss
Kids Learn to Earn deliberately changes how a device behaves, and it interacts with system controls it does not own. You accept that, in the course of normal operation or through fault, it may:
- prevent access to apps you selected, as designed;
- occasionally restrict or fail to restrict an app, show the Shield when it should not, or fail to lift it on time;
- conflict with other apps, parental controls or device-management tools;
- affect battery life or performance; or
- cause a crash, a lockout from an app, or the loss of unsaved data.
to the maximum extent permitted by applicable law, Espyeon LLC is not responsible or liable for device crashes, software conflicts, loss or corruption of data, system lockouts, or any other disruption to a device or its apps caused by the installation or operation of Kids Learn to Earn, by the system permissions or controls it uses, or by their interaction with other software.
The parental override (section 9) lifts all restrictions immediately and is the remedy for any of these. Keep your own backups of anything on the device you would be sorry to lose.
8. Operating-system and platform changes
Apple and Google may change, restrict or withdraw the frameworks and permissions Kids Learn to Earn depends on, or change the rules for apps like it, at any time. If they do, features may stop working, work differently, or become unavailable on some devices or OS versions until we can update the App — and some may not return at all. We will make reasonable efforts to adapt, but we do not guarantee continued compatibility with any device or operating-system version, and to the maximum extent permitted by law we are not liable for any consequence of a third party’s change to its platform.
9. The parental passcode and override
You set a private parental passcode, and may also use Face ID or Touch ID, to reach the parent dashboard and to override restrictions — to clear every block instantly, or to grant bonus time. You are solely responsible for:
- choosing a passcode your child cannot guess, and keeping it secret;
- not entering it where your child can see it;
- making sure that only you can pass any biometric check enrolled on the device; and
- changing it at once if you think your child has learned it.
Anything done through the parent dashboard or an override using your passcode or enrolled biometrics — including changes to rules, bonus time granted, or restrictions removed — is treated as done by you. To the maximum extent permitted by law, we are not responsible for the consequences of a child learning, guessing or bypassing your passcode.
If you forget your passcode, it can be reset through your account, which requires your account credentials.
10. Purchases made on a child's device
Purchases in Kids Learn to Earn are placed behind the parental gate and are then processed and authenticated by Apple or Google — for example with the store account’s password, Face ID or Touch ID, or Family Sharing’s Ask to Buy. To keep purchases under your control, we strongly recommend:
- on Apple devices, setting up Family Sharing and turning on Ask to Buy for your child; and
- on Android, requiring authentication for all purchases in Google Play’s settings.
You are responsible for the security of the store account used on your child’s device. To the extent permitted by law, charges made through that account for Kids Learn to Earn — including a subscription started or changed because a child learned or bypassed your parental passcode or your store credentials — are the responsibility of the account holder.
Because Apple and Google process these payments, only they can issue refunds. If a purchase was made without your permission, request a refund from Apple at reportaproblem.apple.com or through your Google Play order history. We will support any such request where we can.
11. Subscriptions, free trials and billing
Some features — including syncing across multiple devices and the full range of grade levels and question banks — require a paid subscription. Before you subscribe, the App shows the subscription’s name, what it includes, its length and its price. Subscriptions are sold by the Apple App Store or Google Play, under their terms, and:
- Payment is charged to your App Store or Google Play account when you confirm the purchase.
- Subscriptions renew automatically for the same period and at the then-current price unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
- You can manage or cancel at any time in your account settings: on iPhone or iPad under Settings → your name → Subscriptions; on Android in Google Play → Payments & subscriptions → Subscriptions. Cancelling stops the next renewal; access continues until the end of the period you have paid for.
- Free trials, where offered, convert automatically to a paid subscription at the end of the trial unless cancelled at least 24 hours before it ends. Any unused part of a free trial is forfeited when a subscription is purchased.
- Price changes apply only from a future renewal, with the notice and any consent Apple or Google requires.
- Refunds are handled by Apple or Google under their policies, as described in section 10.
- Deleting your account does not cancel a subscription. Cancel in your store settings first.
A subscription is available on each of your devices where the App is installed and signed in to your account, as the App Store Review Guidelines require.
12. Educational content — no guaranteed outcomes
Kids Learn to Earn provides grade-appropriate practice questions and tracks how your child does. We work to make the content accurate and appropriate for each grade, but:
- questions and answers may occasionally contain errors, and grade alignment is general, not tied to your child’s school, curriculum or state standards;
- scores reflect performance on our quizzes only, and are not an assessment, diagnosis or measure of your child’s abilities; and
- the App is not a substitute for school, teaching or tutoring.
Espyeon LLC makes no promise, representation or warranty that using Kids Learn to Earnwill improve your child’s school grades, test scores, academic performance, knowledge, abilities, behaviour or screen-time habits, or produce any particular educational or developmental result.

13. Links, purchases and the parental gate
In keeping with the App Store’s Kids Category requirements, every link that leaves the App — including links to these Terms, the Privacy Policy, our website and support — and every purchase opportunity is placed behind a parental gate. The parental gate is designed to stop a young child, not to verify identity: it does not replace the parental consent described in the Privacy Policy, and you remain responsible for supervising your child’s use of the device.
14. Acceptable use
You must not, and must not help anyone else to:
- use the App in breach of section 4, or for any unlawful purpose;
- create a profile for a child who is not yours to supervise, or enter information about anyone without the right to do so;
- reverse engineer, decompile or disassemble the App, or circumvent its restrictions, parental gate, authentication or licensing, except where the law expressly allows it;
- scrape, copy or redistribute the App’s questions or content, or use them to build a competing product; or
- interfere with the service or place an unreasonable load on it.
Our Acceptable Use Policy also applies.
15. Licence and intellectual property
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your family’s personal, non-commercial use, and to let your children use it through their profiles.
The App — its software, questions, characters, artwork, design and text — is owned by Espyeon LLC or its licensors and protected by intellectual property law. “Kids Learn to Earn” and its logo are our trademarks. You receive no rights beyond this licence.
If you send us feedback, you grant us a perpetual, royalty-free licence to use it without restriction.
16. Third-party services
The App depends on services we do not control — including Apple’s and Google’s operating systems, frameworks and app stores, and cloud hosting. Their availability, behaviour and policies are their own. To the maximum extent permitted by law, we are not responsible or liable for them, and your use of them is governed by their terms.
17. Privacy and your child's information
The Kids Learn to Earn Privacy Policy explains what we collect from you and your child, how parental consent works, how the device controls work, how long we keep information, and your rights — including deleting your child’s information. It is designed to comply with the Children’s Online Privacy Protection Act. The App contains no advertising and no third-party analytics, and we never sell anyone’s information.
18. Availability and changes to the App
We do not guarantee that the App will always be available, uninterrupted or error-free, or that any particular question set, grade level or feature will remain. We may modify, suspend or discontinue any part of it. If we discontinue Kids Learn to Earn entirely, we will give reasonable notice where practical, and the device restrictions it applies will stop.
19. Disclaimer of warranties
the app is provided “as is” and “as available”, with all faults and without warranty of any kind. to the maximum extent permitted by applicable law, Espyeon LLC and its members, managers, officers, employees, contractors, agents, suppliers and licensors (the “Espyeon parties”) disclaim all warranties, express, implied, statutory or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement.
without limiting the foregoing, the Espyeon parties make no warranty that the app will restrict or unrestrict any app exactly as configured; that it will be compatible with any device, operating system or other software; that it will not affect a device’s performance or data; that it will keep a child safe or produce any educational result; or that its questions will be free of error.
some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
20. Limitation of liability
to the maximum extent permitted by applicable law, in no event will the Espyeon parties be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, device damage or malfunction, loss of use, missed communication, educational outcome, or any loss of profits, revenue or goodwill, arising out of or in connection with the app or these terms, however caused and under any theory of liability, whether or not the Espyeon parties were advised of the possibility of such damages.
to the maximum extent permitted by applicable law, the total aggregate liability of the Espyeon parties for all claims relating to the app or these terms will not exceed the greater of (a) the amount you actually paid for Kids Learn to Earn in the twelve (12) months before the event giving rise to the claim, or (b) one hundred united states dollars (us$100).
nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct, and in those cases our liability is limited to the smallest extent the law allows.
The disclaimers and limitations in sections 6, 7, 8, 12, 19 and 20 are a fundamental basis of the bargain between you and us and survive termination.
21. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless the Espyeon Parties from any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of: (a) your use of the App, or your child’s use of it under your account; (b) your breach of these Terms, including section 4; (c) settings you chose; or (d) your violation of any law or of anyone else’s rights.
22. Suspension and termination
You may stop using Kids Learn to Earn and delete your account at any time — see Account & Data Deletion. We may suspend or terminate your account, with or without notice, if you breach these Terms, and will do so if we reasonably believe the App is being used on someone other than your own child. On termination the licence ends and the App’s restrictions stop; sections 6 to 8, 10, 12 and 19 to 24, and any provision that by its nature should survive, remain in effect.
23. Changes to these Terms
We may revise these Terms. We will update the date at the top and, for material changes, notify you in the App or by email before they take effect. Where app store age-assurance laws require a parent’s approval of a significant change, we will report it through the store so that approval can be sought. Continuing to use the App after a change takes effect means you accept it. If you do not, stop using the App and delete your account.
24. Governing law and dispute resolution
These Terms are governed by the laws of the State of Ohio and applicable US federal law, without regard to conflict-of-laws principles.
Informal resolution first. Before bringing any claim, describe the dispute in writing to Contact@espyeon.com and give us sixty (60) days to resolve it.
Binding arbitration. If that does not resolve it, you and Espyeon agree to resolve any dispute arising from these Terms or the App by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court, and either may seek injunctive relief in court for misuse of intellectual property.
you and Espyeon may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. you and Espyeon waive any right to a jury trial.
If this waiver is held unenforceable for a particular claim, that claim alone is severed and heard in court. Nothing here prevents you from reporting a concern to a government agency or waives any right that cannot lawfully be waived.
25. Additional terms for the Apple App Store
If you obtained Kids Learn to Earn from the Apple App Store, you and we acknowledge that:
- these Terms are between you and Espyeon LLC only, not with Apple Inc. (“Apple”), and Espyeon LLC, not Apple, is solely responsible for the App and its content;
- your licence to use the App is limited to a non-transferable licence to use it on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including through Family Sharing where enabled;
- Apple has no obligation to provide any maintenance or support for the App;
- if the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for it; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Espyeon LLC’s responsibility;
- Apple is not responsible for addressing any claim by you or a third party relating to the App or your possession and use of it, including product liability claims, claims that it fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation;
- if a third party claims the App or your possession and use of it infringes that party’s intellectual property rights, Espyeon LLC, not Apple, is solely responsible for investigating, defending, settling and discharging it;
- you represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and are not on any US Government list of prohibited or restricted parties; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and on your acceptance of them Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
26. Additional terms for Google Play
If you obtained Kids Learn to Earn from Google Play, you also agree to Google Play’s Terms of Service, which govern your purchase, and Google is not responsible for the App or its content.
27. General provisions
Severability. If any provision is held unenforceable, it is limited to the minimum extent necessary and the rest remains in effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms; we may, including in a merger or sale of assets.
Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control, including changes to third-party platforms.
Entire agreement. These Terms, with the documents they incorporate, are the entire agreement between you and Espyeon LLC about Kids Learn to Earn.
