EMPS Privacy Policy

EMPS is coaching software, not therapy. It is not counselling, medical advice or treatment, it does not monitor what you write, and it cannot summon help. If you are in crisis, call or text 988 in the US, or 911 if there is immediate danger.
EMPS is a private space for two people. You write things here you may not have said out loud yet — about your relationship, your wellbeing, and your sex life. This policy explains what we collect, who can see it, what leaves our systems, and how to make us delete it.
We have written it to be read rather than skimmed. Section 2 — what your partner can and cannot see — is the one that matters most, and it comes first for that reason.
1. Who we are
EMPS is operated by Espyeon LLC (“we”, “us”), the data controller for the information described here. Contact us at support@empsconnection.com.
2. What your partner can and cannot see
EMPS deliberately keeps two separate channels. This table is the whole of it.

The private channel never leaks into the shared one. Amanda reads your private writing when preparing coaching for you alone. She does not quote it, describe it, or refer to it in the session you and your partner read together — and she does not disclose that a private thread exists at all. Your partner is never told whether you have written anything privately.
This is enforced in our systems rather than left to judgement: private content is separated at the database by row-level security, and the shared session is checked before it is saved.
3. What we collect
Information you give us
- Account — email address, password (stored hashed; we never see it), first name, optional profile photo, time zone.
- Wellbeing check-ins — ratings across emotional, mental, physical, spiritual and relational categories, and any notes you add.
- Intimacy check-ins — levels for emotional and physical intimacy, and what you write about giving, receiving, and what you would like more of.
- Journal entries — shared and private — including the feeling and the need you name alongside them.
- Relationship activity — growth reflections, appreciations, quality time logs, conflict reports, connection rounds, quiz answers, date ideas.
- Answers to Amanda’s questions — about yourself, your partner, or the two of you together.
- Support and feedback — anything you send us directly.
Information we generate
- Your weekly coaching sessions and the evidence supporting them.
- Private coaching written for you alone.
- Working notes Amanda keeps between weeks, so coaching builds rather than restarting.
- Subscription status and entitlement.
Information collected automatically
- Device and app version, operating system, and crash or error diagnostics.
- Standard server logs, including IP address and timestamps, kept for security.
We do not use advertising identifiers, tracking pixels, or third-party analytics SDKs, and we do not track you across other apps or websites.
This is sensitive information and we treat it as such. Much of what EMPS holds concerns your mental health and your sex life. Under the UK and EU GDPR this is special category data; several US state laws treat it as sensitive personal information.
We process it only on the basis of your explicit consent, given when you choose to record it in order to receive coaching. You may withdraw that consent at any time by deleting your account (section 10), which removes the underlying content.
A note about profile photos
If you upload a profile photo it is stored so that your partner’s app can display it. The storage address is long and effectively unguessable, but it is not individually access-controlled — anyone who obtained the exact address could view the image. Do not upload a photo you would not be willing to have seen. No other content in EMPS is stored this way.
4. How we use it, and on what legal basis

5. Artificial intelligence
Your writing is sent to OpenAI. Amanda is built on a large language model provided by OpenAI. To produce your coaching, the content of your check-ins, journal entries, intimacy reflections and answers is transmitted to OpenAI’s API at the moment coaching is generated.
OpenAI processes this on our behalf as a service provider and, under its API terms, does not use data submitted through the API to train its models. We do not use your content to train any model, our own or anyone else’s.
If you are not comfortable with your writing being processed this way, EMPS is not the right product for you. We would rather say that here than have you discover it later.
Coaching is generated automatically. It is not reviewed by a human before you see it, and no employee of Espyeon LLC routinely reads your entries. We may access specific content only where strictly necessary to investigate a fault you have reported, to respond to a legal obligation, or to address a credible safety concern.
Automated processing does not produce decisions with legal or similarly significant effects about you. Coaching is guidance to consider, not a determination.
7. What we never do
- We never sell your personal information, and we never “share” it for cross-context behavioural advertising as those terms are defined under California law.
- We never use your content for advertising, profiling for marketing, or to train AI models.
- We never disclose one partner’s private content to the other.
- We do not run third-party analytics or advertising SDKs in the app.
8. International transfers
We operate in the United States, and our providers process data there. If you use EMPS from the United Kingdom, the European Economic Area, or elsewhere outside the US, your information is transferred to the US. Where required, these transfers rely on the European Commission’s Standard Contractual Clauses and the UK Addendum, together with supplementary measures including encryption in transit and at rest.
9. How long we keep it

Coaching that builds over time needs history to build on, which is why we retain what you record for as long as your account exists rather than expiring it.
10. Deleting your account
You can delete your account at any time, and it is permanent.
- In the app: More → Settings → Delete Account.
- On the web: email support@empsconnection.com from your account address, and we will delete the account and confirm within 30 days.
Deletion removes your account, your entries including your private writing, your coaching, and Amanda’s notes about you. Your partner’s own entries belong to them and are not deleted. Shared coaching sessions the two of you read together may remain in your partner’s history, and messages you chose to share with your partner remain visible to them.

11. Your rights
Depending on where you live, you may have the right to:
- know what we hold about you and get a copy;
- correct inaccurate information;
- delete your information;
- receive it in a portable, machine-readable format;
- object to or restrict certain processing;
- withdraw consent at any time, without affecting processing already carried out;
- not be discriminated against for exercising any of these rights.
Email support@empsconnection.com. We will verify your identity against your account and respond within 30 days, or 45 days where US state law allows an extension and we tell you why. There is no charge.
If you are in the UK or EEA and are unhappy with our response, you may complain to your local supervisory authority.
12. California rights
Under the CCPA as amended by the CPRA, California residents have the rights listed in section 11, plus the right to limit the use of sensitive personal information.
In the preceding 12 months we have collected the following categories: identifiers (email, name); customer records; commercial information (subscription status); internet activity (app diagnostics); and sensitive personal information, namely account credentials and information concerning health and sex life. All of it is collected directly from you and used only for the purposes in section 4.
We have not sold or shared personal information in the preceding 12 months, and we do not do so. We do not use or disclose sensitive personal information for any purpose other than providing the service you asked for, so the right to limit its use does not restrict anything we do. You may still exercise it, and any authorised agent may act for you.
13. Other US state rights
If you live in Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana or another state with comprehensive privacy legislation, you have broadly the rights in section 11, including the right to opt out of targeted advertising, sale, and profiling with significant effects — none of which we do. Where your state provides an appeal process and we decline your request, we will tell you how to appeal.
14. Security
- Data is encrypted in transit (TLS) and at rest.
- Access to private content is enforced at the database by row-level security, so one partner’s account cannot retrieve the other’s private writing even if the app were modified.
- Passwords are hashed; we cannot read them.
- Access by our personnel is limited to those who need it and is logged.
No system is perfectly secure. You are responsible for keeping your own password and device secure, and we recommend a passcode or biometric lock on any device where EMPS is installed — particularly one your partner also uses.
15. Breach notification
If a breach affects your personal information, we will notify you and the relevant authorities without undue delay and within the time limits the law requires — 72 hours to a supervisory authority under the GDPR where feasible. We will tell you what happened, what was affected, and what we are doing about it.
16. Children
EMPS is for adults aged 18 and over. It is not directed at children, and we do not knowingly collect information from anyone under 18. If you believe a minor has created an account, email us and we will delete it promptly.
17. EMPS is not a medical service
EMPS provides relationship reflection and coaching content generated by software. It is not therapy, counselling, medical advice, diagnosis or treatment, and Espyeon LLC is not a healthcare provider. We are not a HIPAA covered entity or business associate, and the information you record here is not protected health information under HIPAA.
Nothing in EMPS should be relied on in place of a qualified professional. If you are in crisis or at risk of harming yourself or someone else, contact emergency services. In the US, call or text 988 (Suicide & Crisis Lifeline), available 24/7, or call 911 if there is immediate danger. The app surfaces these resources where coaching detects language that may indicate risk, but it is not a monitoring or intervention service and must not be relied on to detect an emergency.
18. Changes to this policy
We may update this policy. Where a change materially affects you, we will notify you in the app or by email before it takes effect, and where the law requires it we will ask for your consent again. The version and date at the top always reflect what is current, and continuing to use EMPS after a change takes effect means you accept it.

This policy is governed by the laws of the United States and the State in which Espyeon LLC is organised, without regard to conflict of laws principles, except where the law of your residence requires otherwise.
