HealthTrajectory is an educational tool, not a medical device. It does not diagnose, treat, cure or prevent any disease, and nothing it shows you is medical advice. AI-generated insights can be incomplete or wrong. Always talk to a qualified clinician about your health, and if you think you are having a medical emergency, call 911 or your local emergency number immediately — do not use this app.
Read sections 3 to 6 before you use this app. HealthTrajectory is an educational tool. It is not a medical device, it does not give medical advice, it must never be used in an emergency, and its AI-generated content can be wrong. These Terms also limit our liability and require most disputes to be resolved by individual arbitration rather than in court.
1. Acceptance and eligibility
These Terms & Conditions (the “Terms”) are a binding agreement between you and Espyeon LLC (“Espyeon”, “we”, “us”), governing your access to and use of the HealthTrajectory application and any related website, API or service (the “App”).
By downloading, installing, creating an account or otherwise using the App, you accept these Terms. If you do not accept them, do not use the App.
You must be at least 18 years old to use HealthTrajectory. The App is not offered to, and must not be used by, anyone under 18. We do not knowingly permit the creation of an account by a minor, and we will close any account we discover belongs to one.
These Terms incorporate the HealthTrajectory Privacy Policy and the Espyeon Acceptable Use Policy. Where these Terms conflict with our general Terms of Service on any subject specific to HealthTrajectory, these Terms control.
2. What HealthTrajectory is, and what it is not
HealthTrajectory is a consumer health-tracking and education tool. It lets you record and organise health information, charts how that information changes over time, and produces plain-language educational material and general lifestyle suggestions about what you have recorded.
It is not, and must not be treated as, any of the following:
- a medical device, or any part of one;
- a diagnostic, screening or triage tool;
- a source of medical, clinical, nursing, pharmaceutical, nutritional, psychological or other professional advice;
- a substitute for consulting a qualified healthcare professional;
- a medical record of any legal or clinical standing;
- a monitoring service — nobody at Espyeon reviews your data, and no alert generated by the App is seen by a human who could act on it; and
- a means of obtaining help in an emergency.
3. Not medical advice; no professional relationship
HealthTrajectory provides ai-assisted health tracking, educational insights and general lifestyle suggestions for informational purposes only. the content is not a substitute for professional medical advice, diagnosis or treatment. always seek the advice of your physician or another qualified health provider with any question you have about a medical condition, a symptom, a test result, a medication, or a change to your diet, exercise or treatment.
never disregard professional medical advice, and never delay seeking it, because of something you have read, seen or been shown in this app.
Using the App does not create a physician-patient, clinician-patient, therapeutic, fiduciary or other professional relationship between you and Espyeon LLC or anyone acting on its behalf. We do not practise medicine, we do not provide healthcare, and we are not licensed to do either.
4. Medical emergencies
do not use HealthTrajectory in a medical emergency. if you believe you are experiencing a medical emergency — including chest pain, difficulty breathing, severe bleeding, loss of consciousness, signs of a stroke, an allergic reaction, or thoughts of harming yourself or others — call 911 or your local emergency number, or go to the nearest emergency department, immediately.
In the United States, the Suicide & Crisis Lifeline can be reached by calling or texting 988.
The App does not contact emergency services, does not notify any person, and is not monitored. Nothing you enter into it will reach anyone who can help you.
5. Not a medical device; no regulatory clearance
HealthTrajectory is a general wellness and educational product. it has not been evaluated, cleared or approved by the united states food and drug administration or by any other regulatory authority, and it is not intended to diagnose, treat, cure, mitigate or prevent any disease or condition.
Where the App identifies a trend or highlights an area as worth attention, that output is educational. It is not a finding, a result, a diagnosis or a risk score, it has no clinical validity, and it must not be used as a basis for any healthcare decision. The correct response to such an output is to raise it with a qualified clinician, who can interpret it in the context of your actual medical situation.
The App must not be used by healthcare professionals or organisations to inform the care of any patient, and must not be incorporated into any clinical workflow, decision-support system or medical record system.
6. AI-generated content and its limitations
HealthTrajectory uses automated and artificial-intelligence systems to generate explanations, summaries, trend descriptions and lifestyle suggestions. You must understand the following before relying on any of it:
- It can be wrong. AI systems produce output that is plausible-sounding but inaccurate, incomplete, outdated, internally inconsistent, or entirely fabricated. This is a known and unsolved property of the technology, not a defect we have failed to fix.
- It is general, not personal. Output is generated from patterns in data, not from an assessment of you. It cannot account for your full medical history, your medications, your genetics, your circumstances, or anything you have not recorded.
- It is not reviewed by a clinician. No licensed professional reviews the output before you see it.
- It is not a second opinion. Agreement or disagreement between the App and your clinician means nothing. Your clinician is the one who examined you.
you are solely responsible for evaluating the accuracy, completeness and usefulness of any ai-generated output, and for any decision you make or action you take on the basis of it. do not act on it without confirming it with a qualified professional.
7. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Given the sensitivity of what the App holds, we strongly recommend a unique password and any additional authentication factor the App offers.
Notify us at Contact@espyeon.com immediately if you believe your account has been accessed without your authorisation.
One account is for one person. Do not share an account, and do not use the App to record another person’s health information unless you hold documented legal authority to act on their behalf — in which case you are responsible for complying with every law that applies to that authority.
You may delete your account at any time. See the Account & Data Deletion page.
8. Connected health records
Where your healthcare provider supports it, HealthTrajectory can connect to your electronic health record through Epic’s FHIR / SMART on FHIR integration. That connection is made only when you explicitly authorise it, through your provider’s own authorisation screen, and it is limited to the scopes you approve.
You may disconnect any integration at any time from within the App. Disconnecting stops future retrieval; it does not by itself delete records already retrieved, which you can remove separately as described on the Account & Data Deletion page.
We do not control the source records. Data retrieved from a provider is presented as that provider supplied it. We do not verify, correct, complete or clinically validate it, and it may be inaccurate, out of date, incomplete, mis-coded or attributed to the wrong person. Errors in your medical record must be corrected with the provider that holds it; we have no ability to amend their system. We are not responsible for the availability of any provider’s system, for changes to their API, or for their decision to terminate access.
9. Accuracy of information and your responsibilities
The App can only work with what it is given. You are responsible for the accuracy and completeness of everything you enter, including bloodwork values, units, dates, conditions, medications and dosages. A transposed digit or a wrong unit can produce a materially misleading trend, and the App has no way to detect that.
You also agree that you will:
- not use the App as your only record of any health information you need to keep;
- maintain your own copies of anything important, and not rely on the App for preservation of your records;
- consult a qualified professional before acting on anything the App shows you; and
- continue any treatment prescribed to you unless the clinician who prescribed it tells you otherwise.
10. Permitted and prohibited use
We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to use the App for your own personal, non-commercial health tracking. You may not:
- use the App to provide any service to a third party, or in any clinical, diagnostic, research, insurance, employment, underwriting or forensic context;
- enter another person’s health information without documented legal authority to do so;
- reverse engineer, decompile or disassemble the App, or attempt to extract its models, prompts, or training data, except where applicable law expressly prohibits that restriction;
- scrape, bulk-export or systematically extract content from the App, or use it to build or improve any competing product or model;
- circumvent authentication, rate limiting, or any other technical control; or
- use the App in violation of any law, including laws governing health information.

11. Purchases and subscriptions
Where HealthTrajectory offers paid features, purchases made inside the App are processed by the Apple App Store or Google Play under their terms, not by us. Subscriptions renew automatically until cancelled through the store that sold them, and refunds are governed by that store’s policy. We never receive your payment card details and cannot refund a transaction we did not process. Deleting your account does not cancel a store subscription — you must cancel that separately.
12. Privacy and your data
How we collect, use, protect and share your information is set out in the HealthTrajectory Privacy Policy, and the technical controls are described in the Data Security & HIPAA Framework. We do not sell your personal or health information. By using the App you consent to the processing described in the Privacy Policy, including the automated processing of health information you provide in order to generate the educational output the App exists to produce.
13. Intellectual property; your content; feedback
The App and everything in it — software, models, interfaces, text, graphics and design — is owned by Espyeon LLC or its licensors and protected by intellectual property law. You receive no rights beyond the licence in section 10.
Your data remains yours. You grant us only the licence necessary to host, process, secure and display it in order to operate the App for you, and to comply with law. That licence ends when you delete the data or your account, except for copies in routine backups until they age out on the cycle described in the Privacy Policy.
If you send us suggestions or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use it without restriction or compensation. Do not send us anything you are not willing to have us use freely, and never include personal health information in feedback or support correspondence beyond what is necessary.
14. Third-party services
The App depends on services operated by third parties, including Epic Systems Corporation, your healthcare providers, app stores, hosting and infrastructure providers, and AI model providers. We do not control them and we are not responsible or liable for their acts, omissions, availability, accuracy, security practices or policies. Your use of any third-party service is governed by that party’s own terms.
15. Availability, changes and discontinuation
We do not guarantee that the App will be available, uninterrupted, timely, secure or error-free. We may modify, suspend, limit or discontinue any part of it — including any integration, feature or the App as a whole — at any time, with or without notice, and without liability to you. Because of this, you must not rely on the App as the sole repository of any health information you need to keep. Export anything important.
16. Assumption of risk
you acknowledge that decisions about your health carry inherent risk; that HealthTrajectory is an educational tool whose output may be inaccurate, incomplete or unsuitable for your situation; and that you use it voluntarily and at your own risk. you assume full responsibility for every decision you make and every action you take in connection with the app, including any decision to seek, delay, decline or discontinue medical care.
17. Disclaimer of warranties
the app is provided on an “as is” and “as available” basis, with all faults and without warranty of any kind. to the maximum extent permitted by applicable law, Espyeon LLC and its members, managers, officers, employees, contractors, agents, suppliers and licensors (the “Espyeon parties”) disclaim all warranties, express, implied, statutory or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement.
without limiting the foregoing, the Espyeon parties make no warranty that the app or any output of it will be accurate, reliable, complete, current, clinically valid, or suitable for any purpose; that it will identify any condition, risk or abnormality; that it will not fail to identify one; that it will be available or uninterrupted; or that defects will be corrected. no advice or information obtained from the app or from us creates any warranty not expressly stated here.
some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you; in that case such warranties are limited to the minimum duration and scope permitted by law.
18. Limitation of liability
to the maximum extent permitted by applicable law, in no event will the Espyeon parties be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any personal injury, illness, worsening of a condition, misdiagnosis, failure to diagnose, delayed or forgone treatment, loss of profits, revenue, goodwill or data, or cost of substitute services, arising out of or in connection with the app or these terms — however caused, under any theory of liability (contract, tort including negligence, strict liability, warranty, statute or otherwise), whether or not the Espyeon parties were advised of the possibility of such damages, and even if a limited remedy is found to have failed of its essential purpose.
to the maximum extent permitted by applicable law, the total aggregate liability of the Espyeon parties for all claims arising out of or relating to the app or these terms will not exceed the greater of (a) the total amount you actually paid to Espyeon LLC for HealthTrajectory in the twelve (12) months immediately preceding the event giving rise to the liability, or (b) one hundred united states dollars (us$100).
some jurisdictions do not allow the exclusion or limitation of certain damages, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or willful misconduct. nothing in these terms excludes or limits liability that cannot lawfully be excluded, and in those jurisdictions our liability is limited to the smallest amount permitted by law.
The disclaimers and limitations in sections 15, 16 and 17 are a fundamental basis of the bargain between you and us, allocate risk between us, and survive termination of these Terms.
19. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify and hold harmless the Espyeon Parties from and against any claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms or of any law; (c) information you entered, uploaded or connected, including another person’s health information; (d) any decision you or anyone else made on the basis of the App; or (e) your violation of any third-party right. We may assume exclusive defence and control of any such matter at your expense, and you will cooperate with it.
20. Suspension and termination
We may suspend or terminate your access at any time, with or without cause or notice, including where we reasonably believe you have breached these Terms or that your use creates risk or legal exposure. You may stop using the App and delete your account at any time. On termination the licence granted to you ends immediately, and sections 3 to 6 and 13 to 19, together with any provision that by its nature should survive, remain in effect.
21. Changes to these Terms
We may revise these Terms. When we do we will update the date at the top of this page, and for material changes we will take reasonable steps to give additional notice, such as an in-app or email notice. Continuing to use the App after a change takes effect constitutes acceptance of the revised Terms. If you do not agree, stop using the App and delete your account.
22. Governing law and venue
These Terms and any dispute arising out of them or the App are governed by the laws of the State of Ohio and the federal laws of the United States, without regard to conflict-of-laws principles. Subject to section 23, you and Espyeon submit to the exclusive jurisdiction of the state and federal courts located in the State of Ohio for any dispute not subject to arbitration.
23. Dispute resolution; class action waiver
Informal resolution first. Before filing any claim, you agree to describe the dispute in writing to Contact@espyeon.com and give us sixty (60) days to respond.
Binding arbitration. If that does not resolve it, you and Espyeon agree that any dispute arising out of or relating to these Terms or the App will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court — except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property.
you and Espyeon may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. the arbitrator may not consolidate more than one person’s claims. you and Espyeon waive any right to a jury trial.
If this class action waiver is held unenforceable as to a particular claim, that claim alone will be severed and brought in court, and the rest of this section continues to apply. Nothing here prevents you from reporting a matter to a government agency or waives any right that cannot lawfully be waived.
24. Trademarks and attribution
Epic and MyChart are trademarks of Epic Systems Corporation. FHIR and SMART on FHIR are trademarks of Health Level Seven International and of The Children’s Medical Center Corporation respectively. Apple, App Store, Google and Google Play are trademarks of their respective owners. These marks are used here only to describe interoperability and compatibility. Espyeon LLC is not affiliated with, endorsed by, sponsored by or certified by any of these organisations or by any healthcare provider, and no such relationship should be inferred.
25. General provisions
Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control, including the acts or omissions of a third-party platform or provider system.
Severability. If any provision is held invalid or unenforceable, it is limited to the minimum extent necessary and the rest remains in effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may, including in connection with a merger, acquisition or sale of assets.
Apple and Google. Where you obtained the App from the Apple App Store, the Apple-specific terms in our EULA apply, and Apple is a third-party beneficiary of them.
Entire agreement. These Terms, with the documents they incorporate, are the entire agreement between you and Espyeon LLC regarding HealthTrajectory.
